This Dockaboat Affiliate Agreement (“Agreement”) is entered into between Dock a Boat Applications Inc. (“Dockaboat”, “we”, “our”, or “us”) and the Affiliate (“you”, “your”). By signing up as an affiliate, you agree to the terms and conditions outlined below.

1. Program Overview

dockaboat offers affiliates the opportunity to earn 50% of dockaboat’s net commission/earnings from bookings generated by dock owners they refer. This commission applies for one (1) year from the referred dock owner’s sign-up date.

Key Terms:

  • The 50% commission is based on dockaboat’s net earnings (after applicable taxes, payment processing fees, or refunds).
  • This offer applies only to dock owner referrals and the bookings they generate within one (1) year of sign-up.
  • dockaboat reserves the right to cancel or modify this offer at any time, with or without notice.
Risk of Parties
As an affiliate, you agree to:
 
  • Promote dockaboat in an ethical manner without false or misleading claims.
  • Avoid spammy or deceptive marketing (e.g., unsolicited emails, misleading ads, or misrepresentation).
  • Comply with all applicable laws regarding marketing, advertising, and affiliate promotions.
3. Commission Structure & Payment Terms
  • Calculation: Affiliates earn 50% of dockaboat’s net commission/earnings from the dock owner’s bookings for one year after sign-up.
  • Payment Schedule:
    • Payments are made monthly, on the 15th of each month.
    • The minimum payout amount is $50. If an affiliate’s earnings are below $50, they roll over to the next month.
  • Tracking: Referrals must be made through a unique affiliate tracking link provided by dockaboat.
  • Payment Method: Payments are made via PayPal to the email address provided by the affiliate.
4. Termination & Modifications
  • dockaboat reserves the right to modify or terminate this agreement at any time, with or without notice.
  • If dockaboat terminates the agreement, commissions earned prior to termination will still be paid according to the agreed terms.
  • Affiliates who violate the terms (e.g., fraudulent activity, misrepresentation, unethical marketing) forfeit all pending commissions and may be removed from the program.
5. Legal Disclaimers & Limitation of Liability
  • No Guarantee of Earnings: dockaboat makes no guarantees regarding potential earnings.
  • Independent Contractor Relationship: Affiliates are not employees, partners, or representatives of dockaboat.
  • Indemnification: Affiliates agree to indemnify and hold dockaboat harmless from any claims, damages, or liabilities arising from their promotional activities.
  • Limitation of Liability: dockaboat shall not be liable for indirect, incidental, or consequential damages related to the affiliate program
6. Governing Law & Dispute Resolution
  • This agreement shall be governed by the laws of Florida, USA.
  • Any disputes shall be resolved through binding arbitration in Florida, and both parties waive the right to a jury trial or class action.
